Khanfar Spectrum Analyzer

License Agreement

This License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and MKhanfar ("Developer", "we", "our", or "us") for the software products identified below.

1. Software Products

This Agreement covers the following software products developed by MKhanfar:

Khanfar Free Software:
  • Khanfar Spectrum Analyzer
  • Khanfar RTL Sweeper
  • Khanfar Advanced Spectrum Analyzer
  • Khanfar-FM Radio
  • Khanfar Direction Finder
  • Khanfar Direction Finder QUINTET
  • Quad 3D Spectrum Analyzer
  • Khanfar Spectra-All
  • Khanfar Spot Scanner
  • Khanfar Spot Scanner - CFAR Edition
  • Khanfar Phase-Based Direction Finding
  • Khanfar IQ Live-Rec-Playback
  • Khanfar RTL-SDR CFAR - Mask Analyzer
Khanfar Paid Software:
  • Khanfar Phase-Based DF Calculator
Modified Third-Party Software:
  • Fosphor Spectrum Visualization (Windows Version)

These software products will be collectively referred to as the "Software" in this Agreement.

2. Grant of License

2.1 For Khanfar Free Software:

Subject to the terms of this Agreement, the Developer grants you a non-exclusive, non-transferable, free-of-charge license to:

  • Download, install, and use the Software for personal, non-commercial, or educational purposes.
  • Make copies of the Software for backup purposes only.

2.2 For Khanfar Paid Software (Khanfar Phase-Based DF Calculator):

Subject to the payment of the applicable license fee and your compliance with the terms of this Agreement, the Developer grants you a non-exclusive, non-transferable, device-specific license to:

  • Download, install, and use the Software on a single device.
  • Make copies of the Software for backup purposes only.

The license for Khanfar Paid Software is perpetual and requires a one-time payment. The license is tied to the specific hardware for which the unlock key was issued and cannot be transferred to another device without purchasing a new license.

2.3 For Modified Third-Party Software (Fosphor):

The Fosphor Spectrum Visualization Windows Version is distributed under the GNU General Public License version 3 (GPLv3). The full text of the GPLv3 license can be found at: https://www.gnu.org/licenses/gpl-3.0.en.html

3. Activation Process for Paid Software

Khanfar Phase-Based DF Calculator requires activation through the following process:

  1. After downloading and installing the software, you will be prompted to contact the Developer to purchase an unlock key.
  2. You must send an email to the Developer at the contact email provided in the software, including the hardware identification code displayed by the software.
  3. Upon receipt of payment, the Developer will provide you with an unlock key that is specific to your device hardware.
  4. You must enter this unlock key in the software to activate its full functionality.

The unlock key is valid only for the specific device hardware for which it was generated. Using the Software on a different device requires purchasing a new license.

4. Restrictions

You may not:

  • Modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software (except as permitted by applicable law or for Fosphor as permitted by the GPLv3).
  • Remove any proprietary notices or labels on the Software.
  • Use the Khanfar Free Software for commercial purposes without prior written consent from the Developer.
  • Distribute, rent, lease, sublicense, or transfer the Software to any third party except as specifically permitted in this Agreement.
  • Share, distribute, or publish unlock keys for Khanfar Paid Software.
  • Attempt to bypass, crack, or circumvent the licensing mechanism in the Khanfar Paid Software.
  • Use the Software for any illegal purposes or in any manner that violates applicable laws or regulations.

5. Intellectual Property

The Software is protected by copyright laws and international treaty provisions. The Developer retains all intellectual property rights to the Software (excluding third-party components), including all copyrights, trademarks, and other proprietary rights. You acknowledge that you are only receiving a limited license to use the Software as set forth in this Agreement.

6. Payment and Refund Policy

For Khanfar Paid Software:

  • Payment must be made through PayPal as directed by the Developer.
  • All prices are final unless otherwise specified by the Developer.
  • Refunds may be provided at the sole discretion of the Developer and only in cases where the Software does not function as described. Refund requests must be made within 14 days of purchase.
  • No refunds will be provided once an unlock key has been issued and successfully activated.

7. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.

THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH YOU. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

8. Limitation of Liability

IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Third-Party Components

The Software may include third-party components that are subject to separate license terms. These components include:

  • Fosphor: Licensed under GPLv3, developed by Sylvain Munaut as part of the Osmocom project.
  • RTL-SDR Libraries: Used according to their respective licenses.
  • Open-source libraries: The Software may incorporate various open-source libraries, each subject to its own license terms.

You agree to comply with the terms of all applicable third-party licenses.

10. Term and Termination

This Agreement is effective until terminated. You may terminate this Agreement at any time by destroying all copies of the Software. This Agreement will terminate automatically if you fail to comply with any term of this Agreement. Upon termination, you must destroy all copies of the Software.

For Khanfar Paid Software, the license remains valid in perpetuity for the specific device hardware for which it was issued, provided you comply with the terms of this Agreement.

11. Donations

The Khanfar Free Software is provided free of charge. If you find these products useful, you may choose to make a voluntary donation to support the continued development and improvement of the Software. Any donations are greatly appreciated but are not required to use the Khanfar Free Software.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without giving effect to any principles of conflicts of law.
